Terms and conditions of sale
Last updated: [TO COMPLETE: date — to be set on the day of publication]
⚠️ This English text is a translation provided for convenience. The French version is the authoritative one; in the event of any discrepancy, the French text prevails.
These terms govern every order placed on the DuvalFly online shop. We have tried to write them plainly: if anything seems unclear, write to us and we will explain in plain words.
DuvalFly is a Belgian shop. It sells fly tying materials and, in time, 3D printed parts and fishing gear, to private individuals and to businesses, in Belgium and in the European Union.
1. Who sells on this site
The seller is Smart Horizon SRL, which operates the shop under the trading name DuvalFly. The full identity, registered address, company number and VAT number are on the Legal notice page, which forms an integral part of these terms.
For any question about an order: contact@duvalfly.com and, if you prefer the telephone, [TO COMPLETE: telephone number — MANDATORY in Belgium since 28/05/2022 for an online shop (Omnibus Directive, FPS Economy). Do not publish the page without it.].
2. Who these terms apply to
They apply as soon as you place an order on the site. By confirming your order, you confirm that you have read and accepted them.
If you buy as a consumer — that is, for private use, unconnected with any professional activity — Belgian and European law grants you protections we cannot set aside: the 14-day right of withdrawal (point 8) and the two-year legal guarantee of conformity (point 9). Everything written here is to be read subject to those protections.
If you buy in the course of a professional activity, the right of withdrawal and the consumer legal guarantee of conformity do not apply. Tell us when ordering if you need an invoice showing your VAT number.
The version of these terms binding on you is the one online at the moment you place your order. We may change them for the future, never for an order already placed.
3. The products
Our product pages describe each item as faithfully as we can: material, colour, quantity, use at the vice. The photographs are our own.
Two honest points about natural products:
- Hair, feathers and dubbings are natural materials. Variations in shade, length or density from one batch to the next are normal and are not a defect.
- Screens do not all show colour the same way. A slight difference between the photograph and the item received is not a defect.
Items are sold while stocks last. Our runs are short — often a few units per colour. The stock shown is updated automatically after each payment, but if an item nevertheless turned out to be unavailable after your order, we will tell you and refund the relevant part without delay.
4. Prices
Prices are shown in euros, all taxes included, Belgian VAT included. Smart Horizon SRL is registered for Belgian VAT. All displayed prices include VAT at 21%. Distance sales to other Member States of the Union remain below the threshold of €10,000 per year: Belgian VAT therefore applies to every order and the OSS one-stop shop is not used.
Delivery costs are not included in the price of the items. They depend on the destination and the shipping method chosen, and are shown to you before payment, in the order summary. The total amount payable — items plus delivery — is presented to you before you confirm anything.
The applicable price is the one shown on the site at the moment you order. In the event of an obvious pricing error (an item at €0.59 instead of €5.90, for example), we will contact you: you may confirm the order at the correct price, or cancel it and be refunded in full.
5. Placing an order
The process is as follows:
- you add items to the basket and check its contents;
- you choose the delivery country and the shipping method;
- you reach the payment page, where the summary shows the items, the delivery costs and the total payable;
- you enter your delivery address and contact details, then confirm using a button which states explicitly that the order carries an obligation to pay;
- you receive a confirmation email summarising your order.
That email is confirmation of the contract on a durable medium: keep it, it serves as your proof of purchase. If it has not arrived within the hour, check your spam folder and then write to us.
Delivery restrictions and accepted means of payment are indicated to you at the latest at the start of the ordering process.
We may refuse or cancel an order in the event of unavailability, an obvious pricing error, serious suspicion of fraud, or an unresolved payment dispute on a previous order. In that case, you are refunded what you have already paid.
6. Payment
Payment is made online, at the time of the order, through Stripe — an authorised payment provider. The payment form is supplied by Stripe: your card details never pass through DuvalFly servers and we neither see nor keep them at any point.
Accepted means of payment: card (Visa, Mastercard) and Bancontact.
The order is only final once payment is confirmed by Stripe. The items remain our property until the price has been paid in full.
7. Delivery
Parcels are prepared and dispatched from Belgium.
- Countries served: Belgium and France.
- Carriers: bpost and Mondial Relay.
- Preparation time: [TO COMPLETE: actual time between payment and handover to the carrier, in working days].
- Estimated delivery times: [TO COMPLETE: actual times per carrier and per zone].
- Delivery costs: calculated according to destination and the method chosen, shown before payment. Belgium €5.50, with free delivery from €60 of goods; France €9.90.
Delivery times are estimates which depend on the carrier. Unless otherwise agreed, we undertake in any event to deliver to you within 30 days at the latest after the order is concluded, in accordance with the Code of Economic Law. If that period is not met, you may set us a reasonable additional period, then cancel the order and be refunded.
The risk of loss of or damage to the parcel lies with us until you — or the person you have designated — physically receive the parcel.
In practice:
- Parcel damaged on arrival: photograph the packaging and the contents before unpacking everything, and write to us. We will take care of the rest.
- Parcel marked delivered but never received, or lost parcel: write to us. It is for us to open the enquiry with the carrier, not for you. We will either resend the order or refund you.
- Incomplete or wrong address: if the parcel comes back to us for that reason, we refund the items; the cost of resending is yours.
8. Changing your mind: the right of withdrawal
If you are a consumer, you have 14 days from receipt of your order to change your mind, with no need to justify yourself and with no penalty.
The full details, the exceptions and a model form are on the Right of withdrawal page. In short:
- you tell us within 14 days, by email or using the model form;
- you send the items back within 14 days of your message;
- we refund you within 14 days of receiving your message, as soon as we have received the items or proof that they were sent;
- the refund covers the price of the items and the outbound delivery cost at the standard rate;
- return costs are yours, unless the return is due to a mistake or a defect on our part.
Sale and discounted items carry the same right of withdrawal as any other.
9. If the product is faulty: the two-year legal guarantee
If you are a consumer, you benefit from the two-year legal guarantee of conformity from delivery of the goods. It is free and it comes on top of the right of withdrawal — these are two different things: withdrawal is for changing your mind, the guarantee is for having a problem put right.
Goods are not in conformity if they do not match their description, if they lack the qualities you could reasonably expect, or if they are not fit for the stated use.
During those two years, it is for us to prove that the defect did not exist at the time of delivery, not for you to prove that it did. If a defect appears, we must first repair or replace the item, at no cost to you. If that is not possible, or not done within a reasonable time, you may ask for a reduction in price or for the sale to be rescinded with a refund.
Tell us about the defect as soon as you notice it, at contact@duvalfly.com, with your order number and, if possible, a photograph. A photograph nearly always lets us settle the matter in an exchange of messages.
We impose no 48-hour deadline and no other formal condition on relying on this guarantee: it lasts two years.
The legal guarantee does not cover normal wear, damage caused after delivery, use that does not match the purpose of the item, or the natural variations in shade and texture described in point 3.
10. A complaint? Write to us first
A problem, a question, a disagreement: write to us at contact@duvalfly.com. We reply and we look for a solution. It is almost always the quickest route.
If we cannot reach agreement, you may call on a mediator free of charge:
- the Consumer Mediation Service (Belgium) — Boulevard du Roi Albert II 8 box 1, 1000 Brussels — mediationconsommateur.be — contact@mediationconsommateur.be;
- the Belmed platform of the FPS Economy, for online mediation — economie.fgov.be;
- if you live in another EU country, the European Consumer Centre of your country of residence, which helps free of charge with cross-border disputes.
Please note: the European online dispute resolution platform (ODR) permanently ceased operating on 20 July 2025. Sales sites still pointing to it are giving out-of-date information.
11. Our liability
We are liable for the proper performance of your order: the right item, in good condition, delivered to the address given, with the legal guarantee described in point 9.
We are not liable for the use you make of the items. Tying materials are used with hooks, sharp tools and sometimes chemicals: handling them is your responsibility, and they must be kept out of the reach of children.
Nothing in these terms limits our liability in the event of fraud, gross negligence, or harm to life or physical integrity.
12. Your personal data
The data needed for your order is processed as explained on the Privacy policy page. In short: your order details are processed by Stripe, our content management system holds no customer data, and we resell nothing to anyone.
13. Intellectual property
The texts, photographs, logos and illustrations on the site are our property or are used with permission. You may view them and share them through a link; reproducing or reusing them, in particular for commercial purposes, requires our written agreement.
The products you buy belong to you and you may do as you wish with them: tie them, resell them, give them away. This clause concerns the content of the site, not the items.
14. Force majeure
Neither party is liable for a failure caused by an unforeseeable event beyond its control: natural disaster, carrier strike, general network outage, administrative decision. If the impediment lasts, either party may cancel the order, and sums already paid are refunded.
15. Applicable law and courts
These terms are governed by Belgian law, in particular Book VI of the Code of Economic Law (market practices and consumer protection).
If you are a consumer living in another European Union country, you keep the benefit of the mandatory protective rules of your country of residence: the choice of Belgian law does not deprive you of them.
In the event of a dispute, the Belgian courts have jurisdiction. But if you are a consumer, you keep the right to bring proceedings before the court of your place of residence, and we may only sue you before that court.
16. Changes to these terms
We may change these terms, for example when the law changes or when we add a delivery method. The version applicable to your order is the one online on the day you placed it. The date of the last update is shown at the top of this page.
